Advertiser Terms

These terms and conditions (“Advertising Guidelines”) govern all Advertisers (defined as “Advertiser”,”You” and “Your”) that have an advertisement on the ZEIL platform.
Your access to and use of the information, materials and services provided on the ZEIL platform is conditional on your acceptance and compliance with these Advertising Guidelines.
These Advertising Guidelines are to be read in conjunction with the ZEIL Terms of Use in connection with the provision of services from ZEIL to You.
1. Placing Advertisements
Subject to the creation of a user account and acceptance of the ZEIL Terms of Use, You may from time-to-time, post listings advertising paid (or, only in the case of approved charities, the option for unpaid) employment on the ZEIL Platform ("Advertisement"), provided that:
- (a) Each Advertisement must be:
- (i) A genuine paid opportunity (except in the case of a approved charity seeking volunteers);
- (ii) Current at the time of posting the advertisement; and
- (iii) An opportunity within New Zealand;
- (b) You only upload one Advertisement per legitimate job available;
- (c) You do not post any Advertisements or other material relating to multi-level marketing schemes, or pyramid schemes, club memberships, distributorships or jobs that are entirely or almost entirely commission-based on the ZEIL Platform;
- (d) You must not include links to external application forms or websites in the body or imagery of job advertisement details, previously approved external application forms to Applicant Tracking Systems, or any communications with candidates through the ZEIL Platform;
- (e) Except in the case where a reseller agreement has been explicitly approved by ZEIL, You do not promote other brands that are not associated with the Your business;
- (f) All Advertisements must comply with all applicable legislation, regulations, by-laws, ordinances and codes of conduct, including but not limited to the:
- (i) Fair Trading Act 1986 (subject to the ZEIL Terms of Use);
- (ii) Privacy Act 2020 including the Information Privacy Principles;
- (iii) Real Estate Agents Act 1993; and
- (iv) Human Rights Act 1993
ZEIL reserves the right (at its sole discretion) to determine whether or not posted material breaches the restrictions set out above (or any other provisions of this Agreement or the Standard Terms), and to remove any such material as it sees fit.
2. Content of Advertisements
When posting an Advertisement on ZEIL, You must ensure that:
- (a) Each Advertisement does not discriminate against candidates based on prohibited grounds of discrimination as outlined under Section 21 of the Human Rights Act 1993. This includes, but is not limited to, characteristics such as age, gender, gender identity, religion, ethnicity, race, national origin, disability, sexual orientation etc;
- (b) Each Advertisement is clear and communicates all relevant and factual details. This means that:
- (i) The Advertisement must include the title, responsibilities, qualifications, and if available, job type, as well as information about the employer;
- (ii) The Advertisement must be clear and unambiguous as to what the role and its responsibilities/qualifications entail;
- (c) Each Advertisement must have a job description which matches the job title. Where title and levels vary across companies and industries, it is important to ensure that the job description does not contradict what the job title relates to;
- (d) Each Advertisement has a high degree of professionalism. While it is okay to use different writing styles and terminology to attract specific talent, Advertisements must not contain excessive typos, grammatical errors, unprofessional or inappropriate language, and incomplete sentences;
- (e) Each Advertisement does not have images displaying nudity or inappropriate/obscene imagery; and
- (f) Each Advertisement does not promote or refer to other brands that are not associated with Your business or a business operated by a related party to You.
General
- (a) ZEIL reserves the right to remove any Advertisement which is in breach of these Advertising Guidelines.
- (b) ZEIL reserves the right to, in its absolute discretion (acting reasonably), reject, edit or remove any Advertisement from the ZEIL platform for any reason.
- (c) Any clause within these Advertising Guidelines which is wholly or partially void or unenforceable, is severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of these Advertising Guidelines are not affected.
- (d) These Advertising Guidelines are governed by the laws of New Zealand. You irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of New Zealand, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.
